General KUSP Contest Rules:
Definitions. “Station” refers to KUSP and its licensee, ‘Pataphysical Broadcasting Foundation, Inc. Eligibility and Limitations. Participants and winner(s) must be at least 18 years old, unless different age requirements are specified for a particular Contest. Notwithstanding the above, participants and winner(s) of Contests where prizes involve the participation of premises licensed to serve alcoholic beverages must be at least 21 years old. Only one (1) prize per household will be awarded in any Contest. Employees of the Station and Members of Station’s Board of Directors, and any persons residing at the same household as the employee or director, whether
or not related to the employee or director, are not eligible to participate and win.
Publicity; Privacy. In consideration for accepting any prize awarded in any Contest, winner(s) grant Station non-exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests, in any medium now existing or to be devised in the future, without limitation, in perpetuity, and waive any claims to royalty, right, or remuneration for such use.
Release of Liability. By participating in the Contest, each participant and winner waives any and all claims of liability against the Station, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants may be required to sign a waiver form provided by Station.
Taxes. Any valuation of the prize(s) in any Contest is based on available information provided to Station. Each winner is individually responsible for paying any and all applicable taxes on prizes awarded to them. To receive a prize, a Contest winner must provide Station with valid identification and a valid Federal Taxpayer Identification Number or Social Security Number, if requested. The Station will issue an IRS Form 1099-MISC to any person receiving Contest prizes valued at $600 or more during the course of a calendar year. Prizes are not transferable, not redeemable for cash and not exchangeable for any other prize.
Decisions. By participating in the Contest, participants agree to be bound by the decisions of Station personnel. Station reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means. Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and Station's decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical, technical, electronic, communications, telephone, computer, hardware or software errors,
malfunctions or failures of any kind, intentional interference or any event beyond the control of Station, Station reserves the right to terminate this Contest, or make such other decisions regarding the outcome Station deems appropriate. All decisions will be made by Station and are final. Station may waive any of these rules in its sole discretion.
Miscellaneous. No purchase or donation is necessary to participate or win. Void where prohibited. Odds of winning depend upon the number of participants. Station may substitute prizes of equivalent value, amend the rules or discontinue the Contest at any time as announced on the Station. Station disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. Written copies of these rules are available during normal business hours at the business offices of Station, 203 8th Avenue, Santa Cruz, California 95062, and by mail upon written request when accompanied by a stamped, self-addressed return envelope. All entries become the property of Station and will not be returned.
Governing Law. The conduct of the Contest is governed by the applicable laws of the United States of America and the State of California, which take precedence over any rule to the contrary herein.
